The KP-MTI Appellate Tribunal, under the Health Department of Khyber Pakhtunkhwa, seeks to appoint qualified individuals to serve as Members of the Tribunal. This role involves handling appeals and ensuring the fair administration of justice within the Medical Teaching Institutions (MTIs) framework.

Main Responsibilities

Adjudication of Appeals

  • Review and adjudicate appeals submitted by employees, students, and other stakeholders from Medical Teaching Institutions.
  • Ensure decisions are made by applicable laws, regulations, and policies.

Legal Analysis

  • Conduct thorough legal research and analysis to support tribunal decisions.
  • Prepare detailed written judgments, including findings of fact and legal conclusions.

Hearings and Procedures

  • Conduct hearings, including receiving evidence, examining witnesses, and providing a fair and impartial forum for dispute resolution.
  • Ensure all tribunal procedures adhere to principles of natural justice and procedural fairness.

Case Management

  • Manage caseload efficiently, ensuring timely resolution of appeals.
  • Maintain accurate records of proceedings and decisions.

Collaboration and Consultation

  • Work collaboratively with other tribunal members and legal staff.
  • Consult with legal advisors and other relevant stakeholders as needed.

Compliance and Reporting

  • Ensure compliance with all relevant laws, regulations, and tribunal rules.
  • Prepare and submit regular reports on tribunal activities and outcomes.

Job Requirements

Educational Qualifications

  • A Bachelor’s degree in Law (LLB) from a recognized university. A Master’s degree or higher qualification in law or a related field will be an advantage.

Professional Experience

  • At least 10 years of experience in the legal field, with substantial experience in adjudication, dispute resolution, or a similar area.
  • Previous experience in healthcare law or within medical teaching institutions will be highly regarded.

Skills and Competencies

  • Strong understanding of legal principles, particularly in administrative and healthcare law.
  • Excellent analytical, research, and writing skills.
  • High level of integrity, impartiality, and ability to handle sensitive and confidential information.
  • Strong communication and interpersonal skills, with the ability to manage hearings and interact effectively with various stakeholders.
